The client agree to the following terms and conditions in order to use the graphic design and web design services associated with this web site, thus provided by Wadi Graphic which are identified and/ or described under the graphic design and portfolio navigation bar of this web site
Customer agrees to all rights not expressly granted above are retained by the Wadi Graphic including any electronic (or) digital rights or usage, and including, but not limited to, all rights such as sketches, ideas, or other preliminary materials
- Wadi Graphic will provide set of designs to the client as detailed at the site for that specific design concept and the client is responsible for reviewing the response between stages to get to the final creative design.
- Revision may be made only by the revision times detailed at such design concept type at the sketch stage. More revision requests that depart from the current concept will be considered, however Wadi Graphic reserves the rights to charge $79 for each extra revision.
After you placed your order and the payment is approved we will confirm you and provide the process information of the project. We will then start immediately working on your project, however, we may put your project in schedule if we got other projects on hands ahead of you.
Cancellation fees are due based on the amount of work completed. Fifty percent (50%) of the final fees is due within 30 days of notification that for any reason the job is canceled before the final stage. One hundred percent (100%) of the total fees is due despite cancellation or postponement of the job if the work has been completed. Upon cancellation Wadi Graphic have all rights to ask the client to return all original art or designs, including sketches, comps, ideas or any other preliminary materials.
Wadi Graphic reserves the right to terminate the service, at any time, with or without notice. in case of such termination, Wadi Graphic will work with the client on the process of the amount of refund , if there is any to be paid to the client.
Payment is due for the priced design concepts as detailed on the estimate or contract signed by both parties. Confirmation e-mail will be send with a receipt for such transaction.
Fifty percent (50%) of the charge must be played upfront for the quoted project is necessary to start working on a project. The remaining payment for finished work is due within 30 days. The client ‘s right to use the work is conditioned upon receipt of payment within 30 days of wrapup process. Ten percent (10%) monthly service charges will apply to the late payment.
Client agrees to provide Wadi Graphic with (6 ) sample copies of any printed materials for portfolio purposes.
Client agrees that it shall not hold Wadi Graphic or /agents or employees liable for any incidental or consequential damages that arise from Wadi Graphic’s failure to perform any aspect of the project in a timely manner, regardless of whether such failure was caused by intentional or negligent acts or omissions of Wadi Graphic or a third party.
The client agrees to indemnify and hold Wadi Graphic harmless against any and all claims, costs, and expenses, including attorney’s fee, or materials included the work at the request of the client for which no copyright permission or privacy release was requested, or in which exceeded the uses allowed pursuant to a permission or release.
This agreement shall be binding upon the parties, their heirs, successors, assigns, and personal representatives. This agreement constitutes the entire understanding of the parties. Client may use the service solely in accordance with these terms and conditions of this agreement. Any dispute regarding this agreement shall be arbitrated in ( New York, New York ) under the rules of the American Arbitration Association and the Laws of the state of New York. A waiver of a breach of any provisions of this Agreement shall not be construed as a continuing waiver of other breaches of the same or other provisions. This A agreement shall be governed by the laws of the State of New York and courts of such state shall have exclusive jurisdiction and venue.
